Terms & Conditions

By purchasing a service from Montroy Design ("Montroy Design," "I," "me") and checking the agreement box at checkout, you ("the client," "you") agree to the following terms.
1. Services & scope
The service you purchase includes only what is listed in that product's description. Anything outside that scope, additional pages, extra deliverables, new requests, or work beyond the stated revision rounds is a separate request and will be quoted before any work begins.
2. Payment
Payment is due in full at checkout to reserve your project, unless otherwise agreed in writing. Work begins once payment has cleared and any required materials have been received. Prices are in US dollars.
3. Your materials & responsibilities
To keep your project on schedule, you agree to provide all required content, images, brand assets, and account access within one week of purchase. You are responsible for the accuracy of any content and materials you supply, and you confirm you have the right to use them. Delays in providing materials, feedback, or approvals will extend the timeline accordingly.
4. Timeline
Estimated timelines (for example, "live within two weeks") assume that materials, feedback, and approvals are provided promptly. Montroy Design is not responsible for delays caused by late materials, slow approvals, or third-party services.
5. Revisions
Each service includes the number of revision rounds stated in its description (typically two). Additional revisions beyond that are billed at my day rate of $950/day, in half-day increments.
6. Imagery & content
Custom imagery and design elements created for your project are produced specifically for your brand. Where you provide your own photos or assets, you confirm you hold the rights to use them. Montroy Design is not liable for any claims arising from materials you supply.
7. Ownership & usage rights
Upon receipt of full payment, you own the final approved deliverables for use in your business. Montroy Design retains ownership of all preliminary concepts, drafts, working files, and unused designs. Montroy Design reserves the right to display the completed work in its portfolio and marketing unless you request otherwise in writing.
8. Maintenance & ongoing work
Updates, new pages, and changes after a project is completed are available at my day rate of $950/day, and half-day ($475) increments, with a one-hour minimum.
9. Third-party services
Projects may involve third-party platforms (such as Squarespace, hosting, domains, fonts, or stock assets). You are responsible for any subscriptions or fees charged by those providers. Montroy Design is not responsible for changes, outages, or pricing of third-party services.
10. Cancellations & refunds
Because these are custom creative services, payments are non-refundable once work has begun. If you cancel a project before work begins, a refund may be issued at my discretion, less any time already spent.
11. Communication
Project communication takes place by email at [your email]. I aim to respond within [1–2] business days.
12. Limitation of liability
Montroy Design's total liability for any claim related to a project is limited to the amount you paid for that service. Montroy Design is not liable for any indirect, incidental, or consequential damages, including lost profits or business interruption.
13. Governing law
These terms are governed by the laws of the State of California.
14. Agreement
By checking the agreement box at checkout, you confirm that you have read, understood, and agree to these Terms & Conditions.
